Terms of Service

“Services” means the Muse website, apps, APIs, and any other products, features, or functionality we make available now or in the future. By accessing or using the Services, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 13 years old and have the legal capacity to enter into these Terms to use Muse. You agree to provide accurate registration information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

You retain ownership of the boards, pins, notes, ratings, messages, photos, and other content you create or upload on Muse. By posting content, you grant Muse a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to host, store, display, reproduce, modify, create derivative works of, and distribute that content in connection with operating, improving, and promoting the Services — including, expressly, use in search indexes, recommendation systems, and machine-learning features. This license is granted without compensation to you.

You agree not to misuse the Services. Prohibited conduct includes, but is not limited to:

• Posting content that is infringing, illegal, harassing, or impersonates another person
• Sending spam or unsolicited promotional content
• Scraping or accessing the Services through automated bulk means
• Circumventing security measures or access controls
• Interfering with or disrupting the operation of the Services

We may remove or limit the distribution of any content, and may suspend or terminate accounts, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to the Services or other users.

Muse retains all right, title, and interest in and to the Services, including all associated intellectual property. No rights are granted to you except as expressly stated in these Terms. Third-party product names, images, and trademarks displayed on Muse belong to their respective owners, are shown for identification purposes only, and do not imply any affiliation with or endorsement by those owners.

If you believe content on Muse infringes your copyright, send a notice to avi@musefash.com identifying the copyrighted work, the material you claim is infringing and its location on Muse, your contact information, a statement of your good-faith belief that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act on behalf of the copyright owner, and your physical or electronic signature. We may terminate the accounts of repeat infringers.

Muse is not a seller and is not a party to any purchase you make. All transactions happen on the retailer’s site under the retailer’s own terms. Retailers are solely responsible for their products, pricing, fulfillment, returns, and customer support. Muse makes no warranty as to the accuracy, currency, completeness, or availability of product listings, prices, images, or descriptions shown on the Services.

Some outbound links to retailers are affiliate links that may earn Muse a commission at no additional cost to you — see our Affiliate Disclosure. User ratings and notes reflect the personal opinions of the users who posted them; they are not verified or endorsed by Muse or by any retailer.

Search, recommendations, similar-item results, and other features on Muse use machine learning and may be inaccurate, incomplete, or produce unexpected results. These features are provided for discovery and illustration only, and you should not rely on them as a guarantee of accuracy.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DISCLAIM ALL SUCH WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. MUSE’S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID TO MUSE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You agree to indemnify and hold Muse harmless from any third-party claims, damages, or expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your breach of these Terms.

If a dispute arises, please first contact us at avi@musefash.com so we can attempt to resolve it informally and in good faith. If we cannot resolve the dispute informally, it will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court. YOU AND MUSE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This does not limit either party’s right to seek injunctive or other equitable relief for infringement of intellectual property. You may opt out of this arbitration agreement by sending written notice to avi@musefash.com within 30 days of first agreeing to these Terms. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles.

We may modify these Terms from time to time. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms; we will make reasonable efforts to notify you of material changes by posting them on the Services. We may also modify, suspend, or discontinue any part of the Services at any time without liability to you.

Either you or Muse may terminate these Terms at any time. Sections that by their nature should survive termination — including Your Content’s license, Disclaimers, Limitation of Liability, Indemnification, and Disputes & Governing Law — will survive.

Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muse regarding the Services.
